The Licensing Act provides a mechanism for residents and others to object to the issue of a licence, or to call for a review to be undertaken if a licence has been granted and then problems occur.
The objection or request must be under one or more of the licensing objectives, which are:
- the prevention of crime and disorder;
- public safety;
- prevention of public nuisance;and
- the protection of children from harm.
Anything that does not fall under one of these headings will not be considered by the Hearing, no matter how well-intentioned or problematic.
Requesting and conducting a Review by yourself can be a daunting and difficult task. Collating evidence is in itself very difficult and the right agencies need to be approached to disclose the information that they hold.
When collecting evidence, it is important to be as precise and detailed as possible. Often, objections are not successful simply because there is a lack of evidence that can be tied to the premises in question.
